(hereinafter referred to as the “European Laser Academy”, the “Academy”, “we”, “us” or “our”)
§ 2 Scope of Application
(1) These Terms and Conditions apply to all agreements between the European Laser Academy and its customers concerning digital content, online courses, video courses, masterclasses, lectures, recordings, memberships, downloads, educational materials, workshops, and any other services offered through the website.
(2) These Terms and Conditions apply regardless of whether the customer is a consumer, business customer, physician, therapist, healthcare professional, practitioner, or any other user.
(3) Any conflicting terms and conditions of the customer shall not apply unless expressly agreed in writing.
§ 3 Conclusion of Contract
(1) The presentation of products and services on the website does not constitute a legally binding offer.
(2) By completing the ordering process, the customer submits a binding offer to purchase the selected content.
(3) The contract shall only be concluded upon payment confirmation or activation of the purchased content.
(4) The contract language shall be German and/or English.
§ 4 Services Provided by the Academy
(1) The Academy provides educational and informational content.
This may include:

(2) All content is provided solely for educational, informational and training purposes.
§ 5 Prices and Payment Terms
(1) The prices displayed at the time of purchase shall apply.
(2) Payments may be made using the payment methods offered on the website.

- Other payment providers
(3) The Academy reserves the right to limit or exclude specific payment methods.
§ 6 Customer Accounts

(2) Customers are responsible for keeping their login credentials confidential.
(3) Customers shall be responsible for all activities conducted through their account.
§ 7 Copyright and Intellectual Property

(2) All intellectual property rights remain exclusively with Cell Care Unipessoal Lda and/or the respective rights holders.
(3) The purchase of any product grants the customer a personal, revocable, non-transferable and non-exclusive license for personal use only.
(4) No ownership rights, copyrights or intellectual property rights are transferred to the customer.
§ 8 Prohibited Activities
Customers are strictly prohibited from:
- Sharing account credentials
- Allowing multiple users to access one account
- Recording content
- Downloading content unless expressly permitted
- Publishing screenshots
- Copying videos
- Making audio recordings
- Distributing content
- Uploading content to YouTube
- Publishing content on social media platforms
- Reselling content
- Sharing content with third parties
- Using content for competing educational services
- Using artificial intelligence systems to transcribe, reproduce or create derivative products based on Academy content
§ 9 Account Sharing
(1) Each account is intended for use by one individual person only.
(2) Shared use of accounts is prohibited.
(3) The Academy reserves the right to suspend or terminate access immediately in cases of misuse.
(4) No refund shall be granted in such cases to the extent permitted by applicable law.
§ 10 Medical Disclaimer
(1) All content is provided solely for educational and informational purposes.
(2) The content does not constitute individual medical advice.
(3) The content does not replace professional medical examination, diagnosis or treatment.
(4) No physician-patient relationship is established between participants and instructors.
(5) Medical decisions must always be made independently and under the responsibility of the respective individual.
§ 11 Scientific Content
(1) The Academy publishes content based on scientific literature, clinical experience, professional opinions and medical knowledge available at the time of publication.
(2) Scientific knowledge continuously evolves.
(3) The Academy does not guarantee that content is complete, current or universally applicable.
(4) Users remain responsible for independently evaluating and verifying all information.
§ 12 No Guarantee of Results
(1) The Academy does not guarantee:
- Learning outcomes
- Professional success
- Financial success
- Medical outcomes
- Therapeutic outcomes
(2) Individual results may vary significantly.
§ 13 Digital Content and Right of Withdrawal
(1) Contract performance begins upon the provision of digital content.
(2) The customer expressly agrees that performance may begin before the expiration of any statutory withdrawal period.
(3) The customer acknowledges that such consent may result in the loss of withdrawal rights where permitted by applicable law.
§ 14 Availability
(1) The Academy strives to maintain high platform availability.
(2) Maintenance, updates, security measures or technical issues may result in temporary interruptions.
§ 15 Limitation of Liability
(1) The Academy shall be liable without limitation only in cases of intentional misconduct or gross negligence.
(2) In cases of ordinary negligence, liability shall be limited to breaches of essential contractual obligations.
(3) Mandatory statutory liability provisions remain unaffected.
§ 16 Data Protection
The processing of personal data is governed by the Academy’s Privacy Policy.
§ 17 Force Majeure
The Academy shall not be liable for delays or failures resulting from events beyond its reasonable control.
§ 18 Amendments to these Terms
The Academy reserves the right to modify these Terms and Conditions where legally permissible.
§ 19 Governing Law
These Terms and Conditions shall be governed by the laws of Portugal.
Mandatory consumer protection provisions applicable in the customer’s country of residence shall remain unaffected.
§ 20 Jurisdiction
To the extent permitted by law, the exclusive place of jurisdiction shall be the registered office of Cell Care Unipessoal Lda in Portugal.
§ 21 Severability Clause
Should any provision of these Terms and Conditions be deemed invalid or unenforceable, the remaining provisions shall remain unaffected.
§ 22 Medical Disclaimer
(1) The European Laser Academy provides educational, training, and informational content. All content is intended solely for general education, knowledge transfer, and informational purposes.
(2) The content provided does not constitute medical advice, medical diagnosis, therapeutic recommendations, treatment recommendations, or individualized healthcare guidance.
(3) The use of the content does not create, either expressly or implicitly, any physician-patient relationship, therapist-patient relationship, healthcare provider-patient relationship, or any other professional treatment relationship between participants, instructors, lecturers, authors, contributors, the European Laser Academy, or Cell Care Unipessoal Lda.
(4) Medical, therapeutic, diagnostic, or healthcare-related decisions should never be made solely on the basis of the content provided through the Academy.
(5) Users are responsible for independently evaluating and verifying all information in light of current scientific knowledge, applicable professional guidelines, national laws, regulatory requirements, and their own professional responsibilities.

(8) All procedures, methods, treatment approaches, case studies, clinical experiences, opinions, and assessments presented through the Academy reflect solely the knowledge, experience, and professional opinions of the respective instructors and contributors at the time of publication.
(9) Any implementation, application, interpretation, or use of the information provided is undertaken entirely at the user’s own risk and responsibility.
(10) To the fullest extent permitted by applicable law, the European Laser Academy, Cell Care Unipessoal Lda, Dr. med. Michael Weber, all instructors, lecturers, authors, employees, partners, affiliates, contractors, and contributors shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to diagnostic errors, treatment decisions, therapeutic outcomes, financial losses, health-related damages, personal injuries, or any other consequences arising from the use of the content.
(11) The content is intended for both healthcare professionals and interested members of the public. Healthcare professionals remain solely responsible for their professional decisions, diagnoses, treatments, patient care, and compliance with all applicable laws, regulations, licensing requirements, and professional standards within their respective jurisdictions.
(12) Patients and non-medical users must not regard the content as a substitute for professional medical examination, diagnosis, consultation, treatment, or healthcare services.
(13) In the event of any medical condition, health concern, illness, emergency, or treatment decision, users should seek advice from a qualified physician or other appropriately licensed healthcare professional.
§ 23 Memberships and Subscription Services
(1) The European Laser Academy may offer membership programs, subscription-based services, premium content areas, educational libraries, and recurring access plans (“Memberships”).
(2) Memberships may grant access to specific content, benefits, educational resources, discounts, events, recordings, webinars, or other services as described at the time of purchase.
(3) Membership benefits, available content, features, and services may change over time as part of the ongoing development of the Academy.
(4) Unless otherwise stated, Membership fees are charged on a recurring basis according to the selected billing cycle.
(5) Memberships automatically renew at the end of each billing period unless cancelled before the next renewal date.
(6) Members may cancel their Membership at any time through their account settings or by contacting the Academy.
(7) Cancellation prevents future renewal charges but does not entitle the member to a refund for any current billing period already paid.
(8) The Academy reserves the right to suspend or terminate Membership access in cases of fraud, abuse, unauthorized account sharing, violations of these Terms and Conditions, or unlawful conduct.
(9) The Academy may discontinue, modify, replace, or update Membership programs at its sole discretion, provided that existing contractual obligations are respected.
(10) The Academy does not guarantee uninterrupted access to Membership services and reserves the right to perform maintenance, upgrades, security measures, or platform improvements.
(11) Access rights granted through a Membership remain personal, non-transferable, non-exclusive, and revocable.
(12) Membership access may not be shared, resold, sublicensed, distributed, or otherwise transferred to third parties.
§ 24 Newsletter and Marketing Communications
(1) Users may voluntarily subscribe to newsletters, educational updates, event announcements, product information, promotional offers, and other communications provided by the European Laser Academy.
(2) Newsletter subscriptions are generally processed using a double opt-in procedure where required by applicable law.
(3) Subscribers may withdraw their consent and unsubscribe at any time using the unsubscribe link contained in each communication or by contacting the Academy directly.
(4) The Academy may use newsletter communications to provide information regarding:
- educational content
- new courses
- masterclasses
- memberships
- webinars
- events
- conferences
- promotional campaigns
- Academy updates
(5) Subscription to the newsletter does not create any contractual entitlement to specific content, publication frequency, educational materials, discounts, offers, or future services.
(6) The Academy reserves the right to modify, suspend, discontinue, or replace newsletter services at any time.
(7) Personal data collected in connection with newsletter subscriptions shall be processed in accordance with the Academy’s Privacy Policy and applicable data protection laws.
(8) The Academy may use aggregated and anonymized data regarding newsletter performance, engagement, and communication effectiveness for internal business analysis and service improvement purposes.
§ 25 Artificial Intelligence and Automated Systems
(1) All content provided by the European Laser Academy, including but not limited to videos, lectures, masterclasses, recordings, presentations, transcripts, educational materials, graphics, texts, audio content, and downloadable resources, is protected by copyright and intellectual property laws.
(2) Users are expressly prohibited from using any Academy content, in whole or in part, for the purpose of training, developing, improving, fine-tuning, validating, benchmarking, or operating artificial intelligence systems, machine learning models, large language models, neural networks, automated content generation systems, or similar technologies without the prior written consent of Cell Care Unipessoal Lda.
(3) Users may not use Academy content to create, generate, reproduce, summarize, transcribe, translate, simulate, imitate, or develop competing educational products, training programs, databases, AI-generated content, knowledge bases, or commercial services.
(4) The use of automated software, bots, crawlers, scrapers, spiders, harvesting tools, data mining tools, automated recording systems, automated transcription systems, or similar technologies to access, extract, copy, monitor, collect, reproduce, or analyze Academy content is strictly prohibited.
(5) Users may not upload, submit, transmit, feed, process, or otherwise provide Academy content to any third-party artificial intelligence platform, machine learning service, generative AI system, or automated content processing tool without prior written authorization.
(6) The creation of derivative works, AI-generated reproductions, synthetic training materials, automated summaries, AI-generated course content, or any substantially similar educational materials based on Academy content is strictly prohibited.
(7) Any unauthorized use of Academy content involving artificial intelligence technologies shall constitute a material breach of these Terms and Conditions and may result in immediate suspension or permanent termination of access without refund, to the extent permitted by applicable law.
(8) Cell Care Unipessoal Lda reserves all rights to pursue legal remedies, including injunctive relief, damages, recovery of legal costs, and any other remedies available under applicable intellectual property, copyright, unfair competition, and contract laws.
(9) Nothing in these Terms and Conditions shall be interpreted as granting any license, authorization, permission, or right to use Academy content for artificial intelligence, machine learning, automated processing, or similar purposes.
(10) All rights not expressly granted herein are reserved by Cell Care Unipessoal Lda and the respective intellectual property rights holders.
§ 26 Professional and Regulatory Compliance
(1) Users are solely responsible for ensuring that any use, application, implementation, recommendation, demonstration, purchase, operation, promotion, or professional utilization of information, procedures, techniques, devices, technologies, products, treatments, or concepts presented through the European Laser Academy complies with all laws, regulations, licensing requirements, professional standards, ethical obligations, and regulatory requirements applicable within their respective jurisdiction.
(2) The European Laser Academy makes no representation or warranty that any content, treatment approach, medical device, therapeutic method, educational material, clinical protocol, or professional practice discussed within the Academy is approved, authorized, reimbursable, licensed, or legally permitted in every country, state, province, territory, or jurisdiction.
(3) Users acknowledge that healthcare regulations, professional licensing requirements, advertising restrictions, medical device regulations, reimbursement policies, and clinical practice standards vary significantly between jurisdictions.
(4) Users are solely responsible for obtaining independent legal, regulatory, professional, medical, and compliance advice where necessary before implementing any information obtained through the Academy.
(5) Cell Care Unipessoal Lda, the European Laser Academy, Dr. med. Michael Weber, instructors, lecturers, contributors, employees, and affiliates shall not be responsible for any regulatory, licensing, disciplinary, professional, administrative, civil, or criminal consequences arising from the user’s application of Academy content.
§ 27 No Professional Relationship
(1) Participation in any course, masterclass, lecture, webinar, conference, membership program, educational activity, online discussion, question-and-answer session, forum, email communication, or other service provided by the European Laser Academy shall not establish any physician-patient relationship, therapist-patient relationship, consultant-client relationship, fiduciary relationship, or other professional relationship between participants and the European Laser Academy, Cell Care Unipessoal Lda, Dr. med. Michael Weber, instructors, lecturers, contributors, employees, or affiliates.
(2) Any questions submitted by participants, whether verbally, in writing, through chat functions, email communications, discussion forums, webinars, or live events, are answered solely for general educational and informational purposes.
(3) No statement, response, opinion, comment, case discussion, presentation, demonstration, or educational material provided through the Academy shall be interpreted as individualized medical advice, diagnosis, treatment recommendation, professional consultation, or healthcare service.
(4) Users acknowledge that any professional, medical, therapeutic, business, regulatory, legal, or personal decisions remain solely their own responsibility.
(5) The Academy does not provide healthcare services, medical treatment, patient management, clinical supervision, legal advice, regulatory advice, or individualized professional consulting through its educational offerings.
(6) Users requiring individualized medical, legal, regulatory, financial, or professional advice should consult appropriately qualified professionals within their respective jurisdiction.
§ 28 Reputation, Conduct and Community Standards
(1) Users shall conduct themselves in a professional, respectful, lawful, and ethical manner when interacting with the European Laser Academy, its instructors, employees, affiliates, partners, members, and other users.
(2) Users shall not engage in any conduct that may harm, disrupt, damage, interfere with, or negatively affect the reputation, operations, community, educational environment, instructors, staff, participants, business partners, or intellectual property of the Academy.
(3) Prohibited conduct includes, but is not limited to:
- Harassment
- Defamation
- Threatening behavior
- Discriminatory conduct
- Abusive language
- Fraudulent activity
- Misrepresentation
- Unauthorized commercial solicitation
- Spam
- Distribution of illegal content
- Attempts to disrupt Academy operations
- Public dissemination of false or misleading information regarding the Academy, its instructors, services, or educational content
(4) The Academy reserves the right, at its sole discretion, to remove content, restrict access, suspend accounts, terminate memberships, deny participation in events, or permanently revoke access to Academy services where a user violates these standards.
(5) Such actions may be taken without prior notice where reasonably necessary to protect the Academy, its instructors, employees, participants, intellectual property, reputation, or business interests.
(6) To the extent permitted by applicable law, termination or suspension pursuant to this section shall not create any entitlement to refunds, compensation, damages, or other claims against the Academy.
§ 29 Language and Interpretation
(1) These Terms and Conditions may be provided in multiple languages for the convenience of users.
(2) In the event of any discrepancy, inconsistency, ambiguity, or conflict between different language versions, the English version shall prevail unless mandatory law requires otherwise.
(3) Headings and section titles are provided for convenience only and shall not affect the interpretation of these Terms and Conditions.
(4) The invalidity or unenforceability of any provision shall not affect the interpretation or validity of the remaining provisions.
§ 30 No Professional, Legal, Financial or Business Advice
(1) The content provided by the European Laser Academy is intended solely for educational and informational purposes.
